California's New Law Clarifies Digital Game Ownership
A new California law, AB 2426, mandates greater transparency from digital game stores like Steam and Epic regarding game ownership. Effective next year, these platforms must clearly state whether a purchase grants ownership or merely a license.
The law aims to combat misleading advertising of digital goods. It defines "game" broadly, encompassing applications accessed via various devices, including add-ons and DLC. Stores must use clear and conspicuous language, specifying licensing instead of ownership, with penalties for non-compliance including civil penalties or misdemeanor charges.
The legislation prohibits using terms like "buy" or "purchase" to imply unrestricted ownership unless explicitly clarified. This addresses consumer confusion regarding the nature of digital purchases, which often grant only temporary access revocable by the seller.
Assemblymember Jacqui Irwin highlighted the need for consumer protection in the increasingly digital marketplace, emphasizing the distinction between purchasing a license and owning a digital good outright. She cited instances where companies have removed access to games previously purchased by consumers, often without warning.
However, the law's implications for subscription services like Game Pass remain unclear, as do its provisions regarding offline game copies. The debate continues, particularly given statements by industry figures suggesting a shift towards acceptance of the "renting" model.
A Ubisoft executive previously commented on the evolving consumer perception of game ownership, suggesting a need for adaptation to subscription models. This highlights the ongoing discussion surrounding consumer rights and expectations in the digital gaming landscape.
In essence, AB 2426 seeks to empower consumers with clearer information about their digital purchases, promoting transparency and fairness in the digital game market.
